Terms of Service

1. Acceptance

By creating an account or using the ESE platform you agree to these Terms. If you don't agree, do not use the service.

2. What ESE is — and isn't

ESE is a legal-information and lawyer-marketplace platform. ESE itself is not a law firm and does not provide legal services or legal advice. AI triage, document analysis, and document drafting are informational tools — their output is not legal advice and may be incorrect.

When you book a consultation through the marketplace you enter a lawyer–client relationship with that lawyer, not with ESE. ESE provides the booking and payment infrastructure only.

3. Account & eligibility

You must be at least 18 years old and provide accurate registration details. Lawyer accounts must complete Ghana Bar Association verification before listing on the marketplace. Keep your password and any API keys confidential — you are responsible for all activity under your account.

4. Subscriptions & usage limits

Paid subscriptions are billed monthly in advance through Paystack and renew automatically until you cancel. Cancelling stops auto-renewal — you keep access until the end of the period you've already paid for. Usage limits reset on the first day of each calendar month.

If a renewal charge fails, your subscription enters a 3-day grace window. After 3 days your account is automatically downgraded to the Free tier unless the charge succeeds. No refunds are issued for unused time within a paid period.

5. Marketplace bookings & escrow

Citizens who book a lawyer pay the lawyer's published consultation fee through Paystack. ESE holds those funds in its merchant account as a platform liability ("soft escrow") until the consultation is marked complete, at which point ESE releases the lawyer's share to their registered mobile-money account and retains its service fee (currently 1.99% per booking, subject to change with notice).

This is not regulated third-party escrow. Funds are held by ESE, not by a licensed escrow agent. If the consultation does not happen, contact support@eseghlaw.com within 14 days to request a refund.

6. Acceptable use

You may not use ESE to: submit anyone else's personal data without their consent; transmit malware; circumvent usage limits; impersonate another person; or use the AI features to draft documents you know to be fraudulent. We may suspend accounts that violate these rules.

7. Liability

ESE provides the platform "as is". To the maximum extent permitted by Ghanaian law, our total liability for any claim arising from your use of the service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for: the conduct of any lawyer you book; the accuracy of AI-generated output; or any loss arising from your reliance on the platform for time-sensitive legal matters.

8. Termination

You may close your account at any time. We may suspend or terminate accounts that violate these Terms or that fail payment after the grace window. On termination, your access ends but we retain audit records for compliance.

9. Governing law

These Terms are governed by the laws of the Republic of Ghana. Disputes will be resolved by the courts of Accra unless another forum is required by mandatory consumer-protection law.
